Agreement to These Terms

These Terms of Service (the "Terms") set out the rules for using Tropic Trail Scratch and the related websites, mobile applications, and games (collectively, the "Services") operated by Charger Tech LLC ("Charger," "we," "us," and "our").

By accessing or using the Services, you agree to these Terms. If you do not accept them, do not access or use the Services.

1. Who May Use the Services

The Services are intended only for people who are at least 18 years old, or the higher minimum legal age required by applicable law. By using the Services, you represent and warrant that you meet this requirement. Charger does not knowingly allow anyone below the applicable age to access or use the Services. This restriction is consistent with the Services' IARC content-rating classification.

2. Limited Permission to Use

Provided that you comply with these Terms, Charger grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services solely for your own personal, non-commercial entertainment. Charger retains every right that is not expressly granted in these Terms.

3. Prohibited Conduct

You must not use the Services for an unlawful, fraudulent, or harmful purpose; interfere with their operation or security; use cheats, exploits, bots, automated tools, or unauthorized software; or attempt to gain unauthorized access to Charger systems or data. Charger may reasonably determine whether conduct breaches these Terms.

4. Virtual Items and Transactions

The Services may make optional digital features, items, or content available, including virtual chips, coins, tokens, credits, or similar items ("Virtual Items").

4.1 Purchase Rules

Purchases made through Google Play are governed by Google Play's refund policies. Other purchases are final and non-refundable except where applicable law requires otherwise, including an eligible cooling-off right under the EU Consumer Rights Directive. Charger may change prices at any time.

4.2 What Virtual Items Are

Virtual Items are digital entertainment content only. They have no real-world monetary value, are not gambling, wagering, or real-money activity, and do not give you ownership. Acquiring a Virtual Item gives you only a limited, non-exclusive, revocable license to use it within the Services. Charger may modify, administer, or discontinue Virtual Items at any time without liability.

4.3 Transfers and Exchange Are Forbidden

Virtual Items are non-transferable. You may not sell, trade, gift, or transfer them to another user; buy, sell, or exchange them through a third-party platform, website, or service; or attempt to convert them into real currency, cryptocurrency, or anything of real-world value. Attempts to bypass these restrictions may result in immediate termination of an account without a refund.

5. No Real-Money Gambling

The Services are entertainment products only. They do not offer real-money gambling, betting, wagering, payouts, or prizes of real-world value.

Important notice:

• The Services provide a simulated casino experience solely for entertainment.
• No real currency, prize, or item with real-world value can be won, redeemed, exchanged, or withdrawn.
• Virtual chips, coins, tokens, and credits have no cash value and cannot be exchanged for money, prizes, or anything of value.
• Buying or receiving Virtual Items does not provide a right to winnings, payouts, or real-world rewards.
• Game outcomes do not predict or influence outcomes in real-money gambling.
• Charger does not facilitate, approve, or permit real-money gambling, underground trading, or third-party exchanges involving Virtual Items.

A user who participates in unauthorized trading or real-money exchange activity may have their account permanently terminated.

6. Responsible Play

Charger encourages responsible entertainment. Set personal time limits, take regular breaks, remember that the Services are for entertainment only, and stop playing if it is no longer enjoyable. If you believe you may have a gambling-related problem, consider seeking support from organizations such as the National Council on Problem Gambling, Gamblers Anonymous, or BeGambleAware.

7. Ownership and Intellectual Property

All software, graphics, designs, content, trademarks, and other materials provided through the Services are owned by or licensed to Charger and protected by applicable intellectual-property laws. You may not copy, reproduce, alter, distribute, exploit, or otherwise use any portion of the Services without Charger's prior written permission.

8. Third-Party Services

The Services may include integrations with, or references to, third-party platforms and services. Charger does not control those services and is not responsible for their content, policies, or practices. Your use of them is governed only by their own terms and policies.

9. Warranty Disclaimer

The Services are made available on an "as is" and "as available" basis. To the fullest extent permitted by law, Charger disclaims every express or implied warranty, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Charger does not promise that the Services will be uninterrupted, error-free, or secure.

10. Limits on Liability

To the maximum extent permitted by applicable law, Charger will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to access to, use of, or inability to use the Services. In all events, Charger's total liability will not exceed the amount you paid to us, if any, during the twelve months before the claim. Nothing in these Terms limits liability that cannot lawfully be limited.

11. Suspension and Termination

You may stop using the Services whenever you choose. Charger may suspend or end your access without prior notice if you violate these Terms or applicable law, take part in prohibited conduct including unauthorized Virtual Item trading, or if suspension or termination is necessary to protect the Services, other users, or legal compliance. Following termination, you lose access to Virtual Items in your account and no refund will be provided unless the law requires one.

12. Account and Local Data Deletion

The Services do not require account registration. Local game data, including progress and settings, is removed when you uninstall the application, and there is no separate in-app account-deletion or account-management feature. Third-party SDKs may process anonymous or aggregated information under their own privacy policies and retention periods. Charger does not control those periods but requires providers to comply with applicable data-protection laws.

13. Privacy

Your use of the Services is also subject to Charger's Privacy Policy, which explains our collection, use, and protection of personal information.

14. Revisions to These Terms

Charger may update these Terms from time to time. The "Last Updated" date above identifies the current version. Continued use after an update becomes effective means that you accept the revised Terms.

15. Governing Law and Disputes

These Terms will be interpreted and enforced to the fullest extent allowed by applicable law. Any dispute, controversy, or claim connected with these Terms or the Services must first be addressed through good-faith negotiation. If the matter cannot be resolved that way, either party may seek resolution in a court of competent jurisdiction or through another lawful dispute-resolution process, to the extent permitted by law. Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction for intellectual-property matters, unauthorized access, or other urgent circumstances.

16. Severability

If a provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect.
